🌿 Biokonstra®: Terms of Service & Wellness Partnership
1. About Our Services (What We Do and Do Not Do)
Welcome to the Biokonstra® platform.
What We Do: We help you find natural solutions to optimise your physical performance and general health. Using our years in clinical natural medicine combined with our advanced research engine, AQ, we analyse your existing health data to help reduce long-term inflammation (inflammageing) which is a major contributor to accelerated aging.
Our Core Premise: Most genetic reports are too long and tedious to read, and wearable tracker data (like smartwatches or fitness rings) often becomes ignored background noise. Biokonstra® takes this underused data and turns it into a simple, direct "solution in a capsule."
What We Do Not Do: Biokonstra® is not an emergency medical service, a hospital, or a replacement for your primary care doctor. We do not treat acute illnesses. You must always maintain a relationship with a local doctor for regular medical care and emergency situations.
Strict Software Classification (Not a Medical Device): Neither Konstra nor AQ are medical devices, Software as a Medical Device (SaMD), or Artificial Intelligence as a Medical Device (AIaMD). Under UK Medical Devices Regulations (UK MDR), a medical device must have an explicit medical purpose, such as diagnosing, preventing, treating, or curing a human disease or injury. Because our platform is designed and used exclusively for general wellness education, lifestyle enhancement, and physical performance optimisation, our software does not have a medical purpose and is not regulated as a medical device. All formulation adjustments and data insights are managed and signed off exclusively by your human practitioner.
2. How Your Program Works (Our Methods)
To deliver your personalised wellness plan, Biokonstra® operates through two distinct methods:
Method 1: Personalised Herbal Compounding: Based on a consultation, your genetic data and biomarker trends are analysed by our advanced research engine, AQ, and our team will create custom herbal formulas tailored for you. These bespoke formulas are strictly prepared, mixed, and supplied under the herbal practitioner exemptions of the UK Human Medicines Regulations (specifically Regulations 3 through 12). This ensures your custom blend is made exclusively for your individual use following a direct consultation and is not an unauthorised retail medicine.
The Human Sign-Off (Clinician-in-the-Loop): To ensure your absolute safety, the AI does not have the final say. A certified human practitioner carefully reviews and digitally signs every single personalised capsule order before it goes to preparation.
Method 2: Curated Nutritional Supplements: We select premium, pre-made nutritional supplements to support your plan, sourced exclusively from trusted manufacturers who strictly follow GMP (Good Manufacturing Practice) standards.
3. Joining Fees and Initial Setup
Your journey begins with a transparent, upfront setup process:
Initial Joining Fee: This upfront fee covers the high-accuracy parsing and analysis of your data, your first month of personalised capsule solutions, and a short Telehealth consultation.
Your Duty to Disclose (Material Disclosure): Because your capsule solutions are custom-made for your biology, their safety depends entirely on your transparency. You are strictly required to provide an accurate list of any prescription medications, over-the-counter drugs, and known allergies during your consultation. Biokonstra® accepts no liability for adverse reactions if you fail to disclose complete and accurate health information.
4. Ordering and Payments (Zero Commitment)
We do not believe in locking you into contracts or hidden subscriptions. You are always in complete control of your orders:
Pay-As-You-Go: After your first month, there is no automatic monthly credit card billing.
The Reorder Process: When you are ready for your next batch of personalised capsules, you simply log into your portal and click the Reorder button. This sends an immediate notification to our team.
Invoice & Shipping: Once we receive your reorder request, we generate a new Membership Invoice for your next batch. As soon as you review and pay the invoice, your custom formula is prepared and shipped. You can stop using our service at any time by simply not requesting a reorder.
5. International Shipping, Customs, and Local Laws
Biokonstra® ships products worldwide. Because international supplement regulations vary greatly, we use the following guidelines:
Classification: All items shipped by Biokonstra® are classified and shipped as nutritional supplements.
Your Responsibility: You are the official importer of your supplements. You are entirely responsible for checking if the ingredients in your formula are legal in your country, and you are responsible for paying any local customs fees, import taxes, or duties.
Our Effort: As a courtesy, Biokonstra® uses smart filtering to avoid shipping known banned ingredients to specific regions. However, the final legal responsibility rests with you. Biokonstra® is not responsible for packages delayed, opened, or confiscated by your local customs office.
Customs Failures & Abandonment: Because your daily solutions are custom-blended exclusively for your biology, they cannot be resold or reused if returned. If your home country's customs office delays, holds, or confiscates your package because you refuse to pay local import taxes, or because an ingredient is restricted locally, no refund will be issued. If the shipping company charges Biokonstra® a fee to destroy, abandon, or return the blocked package, you agree to fully reimburse us for those net costs.
6. Data Safety & Privacy Protection
Your genetic data and personal health records are highly sensitive, and we treat them with the highest level of security:
Anonymised Parking & Breach Protection: Your extracted health metrics are completely decoupled from your real name and identity using a secure, random alphanumeric code system and stored in a separate, completely anonymised format. In the highly unlikely event of a security or data breach, your personal privacy remains fully protected because your scientific and genetic metrics cannot be linked back to your real-world identity.
Our Non-Training AI Commitment: When AQ analyses your data, your health information is treated as private, Ephemeral Context inside a secure vault. Your health data is never shared with public networks and is never used to train public AI models. Once your formulation session is complete, it is cleared from the active AI processing memory.
7. Medical Disclaimers & What We Do Not Diagnose
Konstra is a Communication Relay: Konstra is a digital concierge assistant, not a doctor or an advisor. Konstra does not provide health advice, medical opinions, or wellness recommendations. Its role is strictly to serve as a personal liaison—relaying messages, data updates, and questions back and forth between you and your human practitioners.
Human-Driven Choices: All decisions regarding your personalised capsule formulas, lifestyle adjustments, and data interpretations are made exclusively by your human practitioners, who utilise our research engine, AQ, for scientific backend support. Konstra never independently generates advice or dictates your care.
Data is Not a Medical Script: Your genetic files and wearable tracker metrics are used purely to help you understand your lifestyle trends and support your general well-being. They are never to be interpreted as a clinical medical assessment or an official diagnostic report.
No Medical Treatment: Biokonstra® does not diagnose, treat, or cure any medical conditions or diseases. All platform insights are for general performance optimisation and lifestyle enhancement.
Consult Your Doctor: You must always consult with a qualified local physician before starting any new health program or changing your diet, especially if you have an existing medical condition or take prescription medication. Never ignore professional medical advice because of something you read on the Biokonstra® portal.
Automatic Safety Restrictions: Our custom compounding is designed for generally healthy adults looking to optimise their performance. Our solutions are strictly contraindicated, and you must not use our service, if you are pregnant, planning a pregnancy, breastfeeding, under 18 years old, or suffering from severe chronic conditions like active stomach ulcers, bleeding disorders, chronic liver failure, or kidney failure. If you use our portal while matching any of these criteria, you do so entirely at your own risk and we disclaim all liability.
8. Regulatory Compliance & Product Classification (MHRA & FSA)
Because we operate out of the United Kingdom and ship globally, we adhere strictly to UK and international laws regarding herbal and dietary products:
Product Status: Our customised capsule solutions and curated products are classified as food supplements and unlicensed herbal formulations. They are not licensed medicines. They have not been evaluated or approved by the MHRA, the European Medicines Agency (EMA), or the US Food and Drug Administration (FDA) to cure or prevent human disease.
The UK Herbalist Framework: Our personalised herbal compounding is strictly prepared on an individual basis for you following your personalised consultation. This process safely operates under the practitioner guidelines of the UK Human Medicines Regulations. Because these blends are made specifically for your individual wellness path, they are not intended for retail sale, commercial distribution, or sharing with others.
9. Assumption of Risk & Your Personal Responsibility
Every human body and genetic profile is entirely unique. Because biological responses vary from person to person, you understand and agree to the following terms:
Voluntary Participation: You are choosing to participate in this longevity program completely of your own free will. You recognise that optimising your health span requires changes to your lifestyle, diet, and nutrition, and you accept all risks authorised with making these changes.
No Guarantees: Biokonstra® and its research engine, AQ, provide data-driven insights to help optimise your performance. However, we do not guarantee specific health or performance results. Your progress depends entirely on your unique biology, environment, and personal consistency.
Listening to Your Body: If you experience any discomfort, unusual symptoms, or adverse reactions while taking your personalised capsule solutions, you agree to stop taking them immediately and consult your local primary care doctor. You are responsible for updating your personal liaison about any changes to your health status.
No Guarantee Against Natural Deterioration: Our solutions are non-medicinal performance supplements, not cures. Your underlying health or pre-existing medical conditions may naturally change, get worse, or fluctuate due to your individual biology. Biokonstra® makes no promise that your health parameters will automatically improve. If you experience any negative changes or any deterioration in your overall wellness while taking our formulas, you must immediately stop taking them and seek clinical medical care.
Use of Historic Formulations: Because your biomarkers and medications can change over time, your custom formula is carefully balanced only for your current health state. You agree not to consume old stocks of custom capsule solutions months after your initial check-in without placing a fresh reorder or consulting your liaison, to completely avoid any potential adverse reactions from mismatched health metrics.
Strictly Personal Use (No Resale): Every physical solution prepared by our team is custom-compounded exclusively for you based on your specific biometric and consultation files. Your formulas are strictly for your personal use. You are absolutely prohibited from selling, gifting, redistributing, or sharing your personalised capsule solutions with any other person.
10. Complete Release of Liability & Indemnity
By clicking "Agree," using the portal, or making a payment, you explicitly release Biokonstra® from any legal claims:
Waiver of Claims: You agree that you will not hold Biokonstra®, Pharmakopoeia Laboratories, its practitioners, staff, or directors legally responsible for any unwanted side effects, health outcomes, lack of expected results, or personal injuries that you believe arose from our capsule solutions or data analysis.
Limitation of Liability: To the maximum extent permitted by local law, Biokonstra®’s total financial liability to you for any reason whatsoever will never exceed the total amount of money you have actually paid to us for your membership and solutions.
Agreement Not to Sue: You promise that you, your heirs, and your legal representatives will not bring any lawsuit, legal claim, or demand for financial damages against Biokonstra®, Pharmakopoeia Laboratories, or its team for any matters relating to your wellness program.
Time Limit for Legal Claims: To the maximum extent permitted by law, you agree that any legal claim, dispute, or cause of action arising from or relating to your use of the Biokonstra® portal, our data analysis, or our supplements must be officially filed within one (1) year after the event occurred. If a claim is not brought within this one-year period, it is permanently and completely barred.
11. Your Data Rights & Control (GDPR Compliance)
We respect your ownership over your own biological information. Under global data protection laws (including UK GDPR), you have specific, clear rights regarding the data you share through the Biokonstra® portal:
The Right to Know: You can ask us at any time for a clear summary of what personal data and health metrics we have parked in your portal.
The Right to Deletion (The Right to be Forgotten): You are free to withdraw your consent at any time. If you choose to close your portal account, you can request that we permanently delete all of your records and your anonymised health data. Once requested, our team will completely purge your file from our secure servers within 30 days.
How to Exercise Your Rights: To request a copy of your records or a total deletion of your data, simply have Konstra relay your request to our support team, or email us directly.
12. Platform Use, Intellectual Property, and Downtime
Our Content & IP: The design, code, graphics, logos (including Biokonstra®, Konstra, and AQ), text, and proprietary data analysis systems on this website and member portal belong entirely to Biokonstra® (Pharmakopoeia Laboratories). You are granted a limited, personal right to sign in and use the portal for your personal wellness journey. You must not copy, modify, scrape, or reverse-engineer any part of our platform or software.
Portal Availability & Downtime: We aim to provide a seamless digital experience. However, to keep our systems secure and updated, the website or portal may occasionally be temporarily unavailable for scheduled maintenance or unexpected technical updates. Biokonstra® is not liable for any temporary service interruptions or portal downtime.
External Links: Our portal or communication streams may occasionally link to external websites, research papers, or local diagnostic labs. We provide these links strictly for your convenience and educational reference. Biokonstra® does not control, endorse, or accept any responsibility for the content or security of third-party websites.
13. Governing Law, Legal Venue, and Severability
Governing Law: This agreement, your portal use, and all services provided by Biokonstra® are governed entirely by the laws of England and Wales.
The Legal Venue: You and Biokonstra® both explicitly agree that any disputes, legal proceedings, or claims that cannot be settled amicably will be handled exclusively by the courts of England and Wales.
Severability (The Survival Clause): If a court or judge decides that any specific sentence or section of this agreement is invalid or unenforceable under local law, that specific part will be removed. Crucially, the rest of the
